OFFICIAL RULES

1. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. Promotion is offered only at the Jazz CD Basket giveaway (the 

“Event”) at @wusfjazz Instagram social media pages (the “Promotion  Area  ”) on May 3, 2024 - May 30, 2024 Void outside the Promotion Area and where prohibited.

2. Promotion is subject to all federal, state, and local laws. WUSF shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding entries, entry or other deadlines, winner selection, prize restrictions, and eligibility — and all its decisions are final and binding in all Promotion-related matters. By participating, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and the decisions of WUSF.

3. Entries will be accepted from 5/3/24 to 5/30/24 only, beginning at 12:01 AM Eastern Time (“ET”) and ending at 11:59PM ET. Event date and/or time are subject to change depending on weather. Drawing to determine potential winner will be held one week after the conclusion of the Event. You do not have to be present to win. WUSF‘s computer is the official time-keeping device for this Promotion.

4. Promotion is only open to those who subscribe, comment, and tag 2 friends, who are eighteen (18) years old or older. Employees, associates, officers, directors, volunteers and agents of WUSF, any other prize providers or entities directly involved in the development or administration of the Promotion, and the members of their immediate families (defined as spouses, parents, siblings, and children) and households, are not eligible to enter or win. 

5. Prize ( 1 ): Detailed prize description. ARV: $300. The odds of winning depend on the number of entries received. All prize details shall be at WUSF‘s sole discretion. Prize consist only of those items specifically listed as part of the prize description. Winner assume sole responsibility for any expenses and/or costs associated with the prize not expressly included in the prize description. The right to receive a prize is not transferable. Not accepted by the winner is forfeited and no cash or substitute will be offered or permitted, unless required by law. Prize may not be substituted except that WUSF in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.

6. The prize offered is provided “as is” with no warranty or guarantee either express or implied by Released Parties (below). Released Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. There is no warranty or guarantee, expressed or implied, relative to the prize, including but not limited to quality, mechanical condition or fitness, except as may be offered by the manufacturer or otherwise required by law. 7. Entries will be accepted 5/3/24 through 5/30/24 only, starting at 12:01 AM and ending at 11:59 PM ET (the “Entry Period”). To enter, visit @wusfjazz on Instagram. Subscribe to the profile (the “Profile”) and comment under the Jazz Basket Giveaway post by tagging a friend. You may only enter yourself; no third-party entries will be accepted. This is the only method of entry. Entries will not be accepted via U.S. mail, email, or any other method. You can unsubscribe at any time by following the instructions in the Newsletter email.

8. All entries must be received by WUSF no later than 11:59 PM ET on 5/30/24. Limit one (1) entry per person. WUSF is not responsible for electronic communications that are undeliverable because of any form of passive or active filtering. In the event of a dispute as to the identity or eligibility of a winner based on a profile, the entry will be deemed made by the “Authorized Account Holder” of the Instagram profile used for entry. The Authorized Account Holder is the natural person who is assigned to the Instagram profile by the relevant email provider. Entries that omit any required information above may be disqualified without further notification by WUSF. WUSF is not responsible for entries that are lost, misdirected, damaged, incomplete, illegible, incorrect or late for any reason, and all such entries are void. WUSF may disqualify any entry that in its opinion does not comply with these Official Rules. Entry forms become the property of WUSF and will not be returned.

9. Following the Entry Period, WUSF will select one (1) name at random from all timely entries received. Subject to verification of eligibility, the entrant whose name is selected will be declared the winner. WUSF will notify the potential winner based on the account provided at the time of entry. Potential winner must respond to WUSF within forty-eight (48) hours of notification with any requested contact information and, if requested, valid photo ID and signed declaration of eligibility, liability waiver and/or publicity release (where legal) to WUSF. WUSF in its sole discretion may allow for transmission of verification material via email. If potential winner fails to respond to, or cannot be contacted directly by, WUSF within forty-eight (48) hours, declines to accept the prize or is otherwise ineligible, WUSF in its discretion may disqualify that person and will select an alternate winner, who will be subject to all verification requirements above. Confirmed winner will receive instructions from WUSF for claiming or receiving prize.

10.  WUSF may, in its sole discretion, post the verified winner on WUSF‘s websites, including https://www.wusf.org and/or https://www.wsmr.org, or any of its social media channels. By accepting a prize, winner agrees to award WUSF the right to publicize his/her/their name, photograph (including the use and appearance of his/her/their photograph on WUSF‘s websites), likeness, biographical information, email address, voice and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

11.  By entering the Promotion and/or accepting a prize, you agree that WUSF, all other companies involved in the development or administration of this Promotion, the Event host and/or organizer, and a range of subsidiaries, agencies, affiliates, franchisees, promoters, prize suppliers, directors, officers, employees, agents and related persons (collectively, the “Released Parties”): (a) are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, or other errors of any kind, whether human, mechanical, or electronic; or late, damaged, illegible, stolen or misprinted entries; (b) are not responsible for any incorrect or inaccurate information, whether caused by entrants or other participants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion (including any entries) or in the printing of this offer, administration of this Promotion, or in the selection or announcement of the winner or award of the prize (c) are not responsible for unauthorized human intervention in any part of the Promotion; (d) are not responsible for any unauthorized third-party use of any entry materials; (e) are not responsible for the inability to select winner because of postal failure, equipment failure, or data storage failure; (f) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Promotion, the acceptance of entries, the selection of the winner the prize or otherwise in any Promotion-related materials; and (g) are released from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, arising in whole or in part directly or indirectly, from participating in the Promotion (in whole or in part), the use (including modification, adaptation, and reproduction) of entry materials during or after the Promotion, and the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of the prize.

RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO THE PRIZE. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE PROMOTION OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF THE PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. 14.  SOME STATES DO NOT ALLOW LIMITATIONS ON THE ABILITY TO PURSUE CLASS ACTION REMEDIES, OR ON CERTAIN KINDS OF DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

15.  WUSF reserves the right to cancel, suspend or terminate this Promotion, or any part thereof, if WUSF determines, in its sole discretion, that the security, administration, fairness and/or operation of the Promotion has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, regularly scheduled maintenance, malfunction, or any other cause beyond WUSF‘s control. In such an event, WUSF will post notice of same at the Event and select the winner at random from all non-suspect entries received prior to the suspension, cancellation or termination of the Promotion or in such other manner as WUSF, in its sole discretion, deems fair and appropriate under the circumstances.

16.  Note: Without limiting the generality of the foregoing, WUSF reserves the right, in its sole and absolute discretion, to terminate or suspend all or part of this Promotion, in the event that (a) its ability to award the prize or any portion thereof is restricted or prohibited by any federal, state, or local laws or municipal governing or regulatory body or agency, or by law or regulation; (b) the Event is canceled, postponed, or suspended by any third party as a result of any decision, decree or recommendation of any federal, state, or local laws or municipal governing or regulatory body or agency, including any public health authorities or that attendance or participation in the Event is discouraged or recommended against by any public health authority; or that (c) the Event cannot be held as scheduled, or the prize cannot be awarded as offered, as a result of any cause outside of WUSF‘s control and WUSF will have the right in its sole discretion to award a different prize, cancel or rescind the prize and/or cancel the Promotion as a whole.

17.  WUSF reserves the right to disqualify any individual from further participation in the Promotion if WUSF concludes, in its sole discretion, that such person (a) has attempted to tamper with the entry process or other any operation of the Promotion, (b) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (c) has acted towards WUSF or any other entrant or other participant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter more than the number of times permitted herein, including by using any prohibited device or method. Any failure by WUSF to enforce any of these Official Rules shall not constitute a waiver of such Official Rules. All activity arising out of and relating to the Promotion, including reference to any person as a "winner," is subject to verification and/or auditing for compliance with the Official Rules. If WUSF determines, in its sole discretion, that there is evidence of non-compliance with the Official Rules, WUSF may disqualify such entrant from the Promotion and prize at any time. Each entrant agrees to cooperate with WUSF and its representatives in connection with all verification activities. WUSF reserves the right to correct typographical, printing or clerical errors in any Promotion-related materials. No more than the stated number of prizes will be awarded. If production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, WUSF reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.

18.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or Released Parties in connection with the Promotion, shall be governed by Florida law. By entering the Promotion, you expressly (a) agree that any legal proceedings arising out of or relating in any way to this Promotion or these Official Rules shall be brought only in the federal or state courts located in Hillsborough County, Florida, and (b) consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.

19.  Any third-party trademarks mentioned herein are the property of their respective trademark owners and the use or mention of any such third-party trademarks in these Official Rules or in the Promotion is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Promotion or WUSF. Any questions or complaints about this Promotion must be directed to WUSF and not to such third parties.
